TCM Corporation’s Approach to Guarding Personal Information

As a global supplier with complete physical distribution systems for our customers, TCM Corporation (or just "TCM") handles a variety of information including our own technical information and information entrusted to us by customers.

Given this situation, and to ensure that such information is treated with the care it deserves, TCM has established an information management system and is implementing it thoroughly.

In light of these information control issues, and in coordination with the specification of rules and the creation of an information management system, TCM has created the personal information protection policy shown below. Executive staff and ordinary workers have all been informed of this policy and are working to protect your personal information appropriately, according to this policy.

Definition of Personal Information

For TCM, personal information is any information that is related to existing persons which can be used to identify a specific person (for example, names, birth dates, numbers assigned to individuals, symbols or other marks, images, or voice recordings, and other relevant information).

This includes information that cannot be used to identify an individual by itself, but can be used to identify individuals by easy cross-referencing with other data. Personal information is not limited to information that can identify individuals directly, but also includes all information that contains facts, decisions, or evaluations relating to a person's attributes (such as a person's height or build, finances, type of work, or position).

TCM will pay detailed attention to and expend the utmost effort on protecting and managing such information based on the following Personal Information Protection Policy.

Scope

This "About Guarding Your Personal Information" document establishes the TCM method of handling personal information submitted by customers to this website.

TCM Personal Information Protection Policy

1. Collecting, Using, and Providing Personal Information

While carefully considering the protection of customer information during company activities, TCM will handle such information appropriately by establishing a management system for guarding personal information for each type of activity, and also by following the rules we specify for collecting, using, or providing personal information.

2. Following Laws and Norms

TCM will follow the Japanese laws and norms applicable to the protection of relevant personal information in the handling of all personal information. Also, TCM will create and follow personal information management regulations that conform to these laws and norms.

3. Implementing Safety Measures

To ensure the integrity and security of personal information in accordance with the regulations for secure information handling, TCM will implement various measures (such as managing access to personal information, restricting the means for transporting personal information outside the company, and preventing incorrect access from outside the company), and strive to prevent any problems from mishandling personal information (such as the loss, destruction, falsification, or leak of information).

4. Respecting Your Rights Regarding Your Personal Information

When you make a request to learn, correct, or delete the details of your own personal information, seek to prevent the use of such information, or wish not to provide certain information, TCM will respond sincerely and respect your rights related to that personal information.

5. Establishing Regulations for Managing Personal Information and Making Continuous Improvements

TCM will make sure that all executive staff and workers recognize the importance of protecting personal information, and will establish and improve regulations for managing personal information to ensure that such information is only used appropriately and that it is protected. These rules will be maintained and improved continually.

Purpose of Using Personal Information or Providing It to Third Parties

1. TCM will only use personal information to achieve the following listed purposes (hereinafter referred to as the "PURPOSE").

a) To provide information on conventions, meetings, or new products or services

b) To provide various types of member services

c) To provide after-purchase service for products or services

d) To respond to various types of inquiries

e) To perform analyses in order to improve products or services

f) To send out questionnaires

g) To execute contracts

h) To execute our duties according to laws, regulations and norms

2. TCM may provide following companies (hereinafter referred to as the HITACHI GROUP) with some or all of your personal information items for joint use but only to achieve the stated PURPOSE.

a) TCM's affiliated companies (where TCM owns 20% or more of the shares issued) and authorized distributors

b) Hitachi Construction Machinery Co., Ltd. and its affiliated companies (where Hitachi Construction Machinery Co., Ltd. owns 20% or more of the shares issued)

c) Hitachi, Ltd. and its affiliated companies (where Hitachi, Ltd. owns 20% or more of the shares issued)

The TCM department specified in "About Requests to Learn about Personal Information or to Make Complaints" handles inquiries or complaints relating to the joint use stipulated herein.

3. TCM will not provide personal information to a third party without obtaining your prior consent, except for the joint use stipulated in the previous provision or in the following circumstances:

a) When required by law

b) When required to protect human life, to avoid injury, or to protect assets, and when obtaining your consent would be difficult

c) When required to co-operate with the lawful activities of a national agency, local government organization, or person or organization entrusted with such a task, and obtaining your consent would interfere, or be likely to interfere, with the carrying out of such activities

d) When providing personal information to a third party that is a business entrusted by one of the HITACHI GROUP, including TCM, in order to achieve the PURPOSE.

Request to our Customers

1. Most of the services provided by TCM are available without requiring your personal information. However, please understand that some services cannot be provided unless you provide personal information to TCM.

2. Please understand that TCM is not responsible for the safety of personal information you provide to other websites which are linked to the TCM website.

3. It is assumed that you understand and agree to the details in this "About Guarding Your Personal Information" document when you provide personal information to a TCM website. If you do not agree with the methods for handling information outlined in the "About Guarding Your Personal Information" document, you may be unable to use some TCM services (including responses to inquiries, etc.).

About Requests to Learn about Personal Information or to Make Complaints

With respect to personal information maintained by TCM, please take the following steps when requesting TCM to reveal, correct, add, delete, stop using, stop providing to a third party, or disclose the PURPOSE for which personal information has been used (hereafter, collectively referred to as "reveal, etc."), or when making a complaint related to the handling of personal information by TCM or by the HITACHI GROUP in the joint use:

1. For requests to reveal, etc.

Please come directly to TCM's head office. Please understand that TCM may not accept requests to reveal, etc. by mail, telephone or e-mail.

2. Identification of yourself

Please come with an identification document that has your photograph on it (i.e., a passport, driver's license, etc.). When you make a request to reveal, etc., please understand that TCM will make a copy of your identification document.

3. For complaints related to the handling of personal information:

Special Notes:
